: This study raised concerns about problems in the juridical existence ofthe principle of legality in criminal law discovery when judges face a legal vacuum. This study aims to analyze the existence of the discovery of the principle of legality in criminal law. Author elaborates legislation governing the discovery of criminal law. Then the study is associated with the existence of the principle of legality as a principle to be followed in enforcing the criminal law. The approach used in this study is statute approach and comparative. This research is expected to assist the judge in making the discovery of the criminal law in order to satisfy the sense of justice while maintaining the principle of legality.
